Terms of Service

1. Agreement to Terms

By creating an account, accessing, or using the services provided by Pure Indoor Golf LLC("we," "us," or "our"), including our website, application, and indoor golf facility (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Services.

You must be at least 18 years old to create an account. If you are under 18, you may use the facility only with the consent of a parent or legal guardian who agrees to these Terms on your behalf.

2. Account Registration

• You must provide accurate, current, and complete information when creating your account.
• You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.
• Each person may maintain only one account.
• You must notify us immediately of any unauthorized use of your account.
• We reserve the right to suspend or terminate accounts that violate these Terms.

3. Bookings and Facility Use

Our facility is unstaffed (headless). By booking and using the facility, you acknowledge that no staff will be present during your visit and that you are responsible for your own safety and conduct.

• Bookings are subject to availability.
• A confirmed booking constitutes a contract for the reserved time slot.
• You must arrive and use the facility only during your booked time window. Early or late access outside your booking window is not permitted.
• Door access codes are personal, unique to each booking, and non-transferable. Do not share your access codes with anyone.
• Allowing unauthorized individuals to enter the facility using your access code ("tailgating") is strictly prohibited.
• You must follow all posted facility rules and equipment operating guidelines.

4. Cancellation and Refund Policy

• Cancellations made within the allowed cancellation window (as displayed at time of booking) are eligible for a full refund or punch card return.
• Cancellations made outside the cancellation window are not eligible for a refund. Punch card punches used for late-cancelled bookings are forfeited.
• No-shows are treated as completed bookings and are not eligible for a refund.

5. Payments and Pricing

• Prices are listed on the booking page and are subject to change. The price at the time of booking confirmation applies to your reservation.
• All payments are processed securely through Stripe. We do not store your credit card information.
• All prices are in US dollars (USD).
• Applicable taxes may apply and will be reflected at checkout.

6. Punch Cards

• Punch cards are prepaid packages as described at the time of purchase.
• Punch cards may have an expiration date, as specified at purchase.
• Punch cards are non-transferable between accounts.
• Punch cards are non-refundable after purchase, except as required by law.
• When multiple punch cards are available, the oldest expiring card is used first.

7. Memberships

• Memberships are recurring subscriptions billed through Stripe on a monthly basis.
• Your membership auto-renews each billing period unless you cancel before the renewal date.
• Membership upgrades take effect immediately, with prorated billing for the remainder of the current period.
• Membership downgrades take effect at the end of the current billing period.
• If you cancel your membership, you retain benefits until the end of the current billing period.
• Included hours (for applicable membership tiers) do not roll over between billing periods.

8. Promo Codes and Discounts

• Promo codes are subject to the specific terms, usage limits, expiration dates, and eligibility requirements specified per code.
• Promo codes cannot be combined with other offers unless explicitly stated.
• We reserve the right to void promo codes used in violation of their terms or obtained through fraudulent means.

9. Liability Waiver

You must sign our digital liability waiver before your first booking. The waiver is a separate legal agreement that addresses the inherent risks of using golf simulator equipment. If we update the waiver, you may be required to accept the new version before making additional bookings.

Use of golf simulators carries inherent risks including but not limited to physical strain, injury from golf club use, and trip or fall hazards. By using the facility, you accept these risks as outlined in the liability waiver.

10. Facility Rules and Conduct

• You may be charged for any damage to equipment, furnishings, or the facility caused by your negligence or misuse.
• No unauthorized persons are permitted in the facility. Only individuals with a valid booking and access code may enter.
• Tailgating (allowing others to enter with your access code) is prohibited and may result in account suspension.
• Video surveillance and monitoring may be in place for security purposes.
• We reserve the right to immediately revoke facility access for any violation of these rules.

11. Intellectual Property

The application, website, branding, logos, and all content are the property of Pure Indoor Golf LLC. You may not copy, modify, distribute, or create derivative works from our content without prior written consent.

12. Limitation of Liability

Our Services are provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

To the maximum extent permitted by law, Pure Indoor Golf LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services, equipment malfunction, personal injury, property damage, service interruptions, or any other matter relating to the Services.

Our total liability for any claim arising from these Terms or the use of our Services shall not exceed the total fees you paid to us in the twelve (12) months preceding the claim.

13. Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Oregon, without regard to conflict of law principles. Any disputes arising from or relating to these Terms or the Services shall be resolved exclusively in the state or federal courts located in Multnomah County, Oregon.

Before initiating any legal action, you agree to first attempt to resolve the dispute informally by contacting us at info@pureindoorgolf.com. We will attempt to resolve the dispute within 30 days.

14. Termination

• We may suspend or terminate your account at any time for violation of these Terms, with or without notice.
• You may delete your account at any time through your account settings or by contacting us.
• Upon termination, certain data may be retained as described in our Privacy Policy.

15. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or by posting a prominent notice on our website. Your continued use of the Services after any changes constitutes your acceptance of the updated Terms.
